Well, a long time since we discussed these libel fools. Readers will recall that Edwin Coe on behalf of their client conducted a 'libel onslaught' upon numerous posters on ADVFN.com - a financial bulletin board - for alleged defamatory statements about their dopey client. Naturally the cases were dismissed by Eady J because they were considered trivial.
In the complaint to the Solicitors Regulator it was brought to their attention that EC's client had been using the bulletin board to intimidate posters who he claimed had previously defamed him. Anyway the question was asked - in view of the threats made and the posting up of Edwin Coe's contact details on the BB - whether EC aware of these threats? If they were, it might be a further reason for Edwin Coe to be disciplined for breaches of the Solicitors Code of Conduct. You see, solicitors might not like it, but they have a duty not to take an unfair advantage of other parties for their own benefit or for the benefit of their client. This,together with the numerous pre-action protocols breaches they performed during the proceedings might suggest that there is a case to answer. The claimant posted up Edwin Coe's address encouraging posters to settle in circumstances where it was clear to anyone with knowledge of defamation that the cases would fail. These posts were made between 2007 all the way up to when the claims were dismissed. It also came to light that the claimant was using up to 50 user names on the website to intimidate others with the threats. Anyway - I have just come across more threats (see below) which were made at the time. Readers will no doubt question whether or not Edwin Coe were aware of these threats and if so, why they did not restrain their client from making them. This whole episode a complete disgrace from start to finish. Posts made by the claimant to the defendants before the ludicrous High Court claims were issued: Anomalous - 19 Apr''07 - 12:37 - 53971 of 53971 >Dr Jekyll You could have purged your libel at no cost, had you chosen to do so correctly yesterday. As you know, under the Defamation Act, I could seek liquidated damages of at least £10,000. Therefore I feel that you ought to demonstrate your regret by making a donation of £100 to charity - by cashiers cheque payable to Edwin Coe Solicitors at 2 Stone Buildings, Lincoln''s Inn, London, WC2A 3TH. More than one of the individuals is in settlement talks. Quite a few actually. The smart ones are getting in quick whilst they can. High Court claims are being issued and more are to come over the following weeks. The number of settlements and admissions of defamation will weigh against the others that try to hold out. I hear that he's even going to empty Clem's piggy bank. Doubt if the shareholders will get a divi next year though, given that the lawyers will enjoy spending it all...!
